As stated in the University of Illinois System Non-Discrimination Statement, the commitment of the University of Illinois System to the most fundamental principles of academic freedom, equality of opportunity, and human dignity requires that decisions involving students and employees be based on individual merit and be free from invidious discrimination in all its forms.

The Office of the Vice Chancellor for Access, Civil Rights & Community is responsible for the following policies and procedures in efforts to uphold the System’s non-discrimination statement on behalf of the University of Illinois Urbana-Champaign.

Purpose: In furtherance of Illinois’ commitment to the principles of equality and equal opportunity, this policy may be invoked by University of Illinois Urbana-Champaign students, applicants, visitors, faculty, staff, employees, former employees, and any other person participating in, or seeking to participate in, a university program or activity.

Accessibility and Disability-Based Accommodations

Academic Accommodations Implementation Review (AAIR) Process

Responsible Office: ADA Coordinator Office

Purpose: The purpose of the Academic Accommodation Implementation Review (AAIR) is to provide a means for students, with the assistance of the ADA Coordinator, to promptly address disputes that may arise related to the implementation of academic accommodations and minimize any potential disruption to a student’s access to, or performance in, an academic course or program.

Digital Accessibility Policy

Purpose: This policy establishes the standards for digital accessibility of Information and Communication Technology (ICT) to ensure technologies developed, procured, maintained, used, or provided by the University for the purpose of interaction and creation and manipulation of data comply with applicable state and federal laws.

Purpose: These procedures outline the resolution processes that will be used to investigate and/or resolve a report of harassment, discrimination, and/or retaliation under the Nondiscrimination Policy, including ADA/504 grievances. Complaints or grievances under the Americans with Disabilities Act or the Rehabilitation Act will be shared with, and addressed in consultation with, the ADA Coordinator.

Reasonable Accommodations Policy and Procedures (Employees)

Purpose:  The purpose of this policy is to promote equal access to employment opportunities and other programs and activities of the university. This policy sets forth the rights of university employees and other individuals to reasonable accommodations under the Americans with Disabilities Act and other laws.

This policy applies to all university employees (including undergraduate and graduate student employees in their employment context), applicants for employment and visitors and guests to the university.

Student academic accommodations under Student Code Sections 1-107 and 1-110 and the Pregnancy and Related Conditions Policy (CAM HR-49) are outside the scope of this policy.

Purpose: The purpose of this policy is to ensure that individuals with disabilities who require the use of Service or Emotional Support Animals have equal access to university programs, services, and activities, in accordance with state and federal law. This policy also addresses the admissibility of other animals on campus.

ADA Transition Plan Documents

Responsible Office: ADA Coordinator Office and various university departments

Purpose: The Americans with Disabilities Act of 1990 (Title II) requires a public entity to make its programs, activities and services accessible to and usable by persons with disabilities except where to do so would result in a fundamental alteration in the nature of the program or in undue financial and administrative burdens. Public entities are directed to identify where physical changes to facilities are necessary to render programs accessible (where relocation of the program to accessible facilities or use of alternative methods to achieve accessibility are not possible). Where physical alterations to facilities are required, a transition plan which identifies the physical barriers that limit access to programs, activities, or services to individuals with disabilities, is required.

Campus Belonging Bias Response Protocol

Responsible Office: Office of the Vice Chancellor for Access, Civil Rights & Community

Purpose: The Campus Belonging process provides a mechanism for members of our campus community to share concerns about behaviors that negatively affect their experience on campus, educates the campus on relevant issues related to diversity, equity, inclusion, access, free speech, and academic freedom, and strives to consistently affirm our institutional commitment to a campus environment that values diverse perspectives and constructive dialogue.

Religious Accommodations

Responsible Offices: The Office of the Dean of Students (for class attendance or participation in a scheduled examination); Office for Access & Equity (for workplace accommodations, including student employees)

Purpose: It is the policy of the University of Illinois Urbana-Champaign to reasonably accommodate its students’ religious beliefs, observances, and practices that conflict with a student’s class attendance or participation in a scheduled examination or work requirement, consistent with state and federal law. University employees are entitled to reasonable workplace accommodations on the basis of religious beliefs, observances, and practices. This includes student employees seeking job-related accommodations.

Salary Discrimination

Purpose: University policy prohibits salary discrimination based on sex, race, color, national origin, religion, and other protected classifications. Complaints should be directed to the Office for Access and Equity and will be addressed pursuant to the Nondiscrimination Policy or the Sexual Misconduct Policy.

A faculty member who believes their salary is inequitable for non-discriminatory reasons can share their salary concerns with their UEO/Department Head or Chair.

Academic Professional salary equity concerns that are not related to a protected classification should be directed to Compensation, Classification and Career Architecture within IHR: ihr-compensation@mx.uillinois.edu.

Title VI Misconduct Report Procedures

Responsible Office: Title VI Office

Purpose: These procedures outline the resolution process that will be used by the Title VI Office to address a report of harassment, discrimination, and/or retaliation based on race, color, or national origin, including actual or perceived shared ancestry or ethnic characteristics, as prohibited by Title VI of the Civil Rights Act of 1964.

Sex, Sexual Orientation, and Gender Identity

Pregnancy and Related Conditions Policy

Responsible Office for Policy: Office of the Chancellor

Purpose: This policy addresses the university’s responsibilities involving pregnancy and related conditions under state and federal law, including Title IX of the Education Amendments of 1972, the Pregnancy Discrimination Act, the Pregnant Workers Fairness Act, the PUMP Act, the Illinois Human Rights Act and the Nursing Mothers in the Workplace Act. Students and employees who are affected by pregnancy or pregnancy-related conditions and who are seeking modifications and accommodations related to their education and/or work, including leaves of absence, may seek assistance under this policy.

Procedures for Addressing Title IX Sexual Harassment Complaints

Responsible Office: Office for Access & Equity

Purpose: These Procedures for Addressing Title IX Sexual Harassment Complaints (“Procedures”) outline the resolution processes that will be used to investigate and/or resolve a complaint of Title IX Sexual Harassment (as defined in the Sexual Misconduct Policy after August 14, 2020) that occurred after August 14, 2020, and that meet the following criteria:

a. The conduct took place in the United States of America;

b. The conduct took place on University premises or property, at a University-sponsored event, or in buildings owned or controlled by the University’s recognized student organizations, or if the alleged conduct effectively deprived someone of access to a University educational
program;

c. The Respondent is a member of the University’s community; and

d. The Complainant was participating in or attempting to participate in the education program or activity at the time the Formal Complaint was filed.

Student Pregnancy and Related Conditions Reasonable Modifications Process

Responsible Office: Title IX Office

Summary:  A student may request a reasonable modification based on pregnancy or a related condition from the Title IX Office. The Title IX Office will meet with the student as part of an individualized assessment to determine what modifications are reasonable. Each reasonable modification will be based upon the student’s individualized needs and the nature of the academic program the student is participating in.

Sexual Misconduct Response

Purpose: The purpose of this policy is to provide a safe and welcoming educational and work environment and to establish standards of conduct that are appropriate for our campus community; and to comply with Title IX of the Education Amendments of 1972 (“Title IX”), 20 U.S.C. § 1681 et seq., and its implementing regulations, 34 C.F.R. Part 106; Section 304 of the Violence Against Women Reauthorization Act of 2013 (“VAWA”), 20 U.S.C. 1092(f), and its implementing regulations, 34 C.F.R. Part 668.46; Title VII of the Civil Rights Act of 1964 (“Title VII”); the Illinois Human Rights Act; and the Illinois Preventing Sexual Violence in Higher Education Act, 110 ILCS 155/1 et seq.

Responsible Employee Reporting Obligations

Responsible Office: Title IX Office

Summary: Responsible employees must immediately report allegations or disclosures of sexual misconduct (per the Sexual Misconduct Policy) to the Title IX Office.

All University employees – including tenure and non-tenure track faculty, specialized faculty, academic professionals, visiting academic professionals, postdoctoral research associates and fellows, all graduate student employees, academic hourly, civil service, extra-help, medical or veterinary residents – are deemed responsible employees.

The following groups of undergraduate student employees are considered responsible employees: resident advisors, student patrol officers, and teaching assistants.

Because the definition of responsible employee is so broad, you should consider yourself a responsible employee unless you qualify as a confidential resource. (Confidential resources on campus include the Counseling Center, the Women’s Resources Center, and McKinley Health Center.)

Non-Exclusive List of Potential Supportive Measures and Corrective Action Remedies

Responsible Office: Title IX Office

Summary: Supportive measures are non-disciplinary, non-punitive individualized services offered as appropriate, as reasonably available, and without fee or charge to the complainant or the respondent before or after the filing of a formal complaint of sexual misconduct or where no formal complaint has been filed. The University must maintain as confidential any supportive measures provided to the complainant or respondent, to the extent that maintaining such confidentiality would not impair the ability of the University to provide the supportive measures.

Reporting to External Agencies

Anyone who believes they have experienced discrimination or harassment, including sexual misconduct, at the University of Illinois Urbana-Champaign has the right – and may initiate – a complaint with an appropriate state or federal compliance agency. Students and employees may file sexual misconduct complaints with the Illinois Department of Human Rights (IDHR). Students may also file complaints with the U.S. Department of Education, Office for Civil Rights (OCR). In addition, any University employee may file a complaint with the U.S. Equal Employment Opportunity Commission (EEOC). Contact information for each agency appears below.
